1. PURPOSE OF THIS NOTICE

As part of its activities, IDIS, as a data manager, is required to collect personal data, protected by the following :

  • The EU Regulation 2016/679 of the European Parliament and of the Council on April 27, 2016 and put in practice after May 25, 2018 (hereafter referred to as “the European data protection regulation” or “RGDP”) • The Data Protection Act and Freedoms n°78-17 of January 6, 1978 as amended• The advice and recommendations of supervisory authorities, the Group for personal data processing protection (“G29 Group”) or the European Committee for Data Protection (CEPD).

The purpose of this notice is to inform you of: • The types of data we collect; • Why we use and share this data; • Retention periods; • Your privacy rights and how you can exercise them.

  1. A FEW DEFINITIONS
  • “Personal data:” any information relating to a naturally identifiable person or who can be identified directly or indirectly by an identification element such as a name, phone number, mailing address, email address, identification number, location data…
  • “Personal data processing:” any operation carried out on personal data, including its collection, recording, organization, storage, adaptation, modification, extraction, consultation, use, interconnection, limitation, erasure, destruction…
  • “Data controller:” the physical or legal person, public or private, or the service, who determines, alone or collectively, the purposes of means of processing.
  • “Subcontractor:” the physical or legal person, public or private, or the service which processes personal data on behalf of the data controller

 

 

  1. WHAT PERSONAL DATA DO WE USE?

Information you have provided to us, depending on the branch you contacted, primarily information necessary to offer you the information and advice regarding your rights and appropriate support but also to communicate with you, know you better, and develop a relationship with your association. For example, this information includes your name, your email address, your mailing address, you phone number.

If you are under 18 years old, ensure you receive permission from your parents or legal guardian before sending us any information regarding: your name, your address, and your email address.

Information Collected Automatically

This includes information stored automatically by cookies and other session tools. For example, your IP address. This information is used to improve your user experience. When you use our services and you consult website content, your activity may be logged.

Information Collected from Third Parties

As part of its activities, IDIS can collect data from you or from the following sources: social workers, agents, legal representatives of individuals like minors or protected adults, institutional partners.

  1. FOR WHAT PURPOSES AND ON WHAT BASIS DO WE USE YOUR DATA?

We use your data to:

  • Respond to your request
  • Improve your user experience
  • Fulfill a legal or contractual obligation

We use your personal data for legitimate reasons and/or with your consent.

Due to the contract’s conclusion or the fulfillment of contractual obligations, we process your personal data for the following purposes:

  • To identify you
  • To provide and offer you products and services
  • To communicate with you.

We can process your personal data for other reasons not mentioned here, but which are compatible with the original purpose for which the data was collected. To do this, we ensure that :

  • The link between the purposes, context and nature of the personal data is suitable for further processing;
  • The further processing would not harm your interests and there would be an appropriate safeguard for the processing. We will notify you of any further processing and of those purposes.
  1. WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

In order to comply with the aforementioned goals, we only share your personal data with the following individuals and entities, where applicable and depending on the type of contract:

  • Our employees and our volunteers in charge of managing your requests;
  • Interested parties in the event of litigation: lawyers, experts, social workers;
  • Financial and judicial authorities, arbitrators and mediators, public agencies and state agencies, upon request and as permitted by law;
  • Our subcontractors and marketing service providers.

 

  1. HOW LONG DO WE KEEP YOUR PERSONAL DATA

The data can only be kept for a limited time and IDIS does not keep your data beyond the time necessary for the operations for which it was collected. Your personal data is therefore kept for the time necessary to fulfill the purposes for which it is collected and processed. They will then be securely destroyed or anonymized. When personal data is collected for numerous purposes, it is kept until the longest storage or archival period has expired.

 

  1. WHAT ARE YOUR RIGHTS AND HOW CAN YOU EXERCISE THEM?

In accordance with the applicable regulations, you have the following rights:

  • Right to access: you can obtain information relating to the processing of your personal data, and a copy.

Procedures concerning your request for right of access

In your request, please specify the data or processing operations to which it relates. Your data will be sent to you either by email, if your request was made electronically, or by registered mail with acknowledgment of receipt. In the event of a request by mail, IDIS may require the payment of a reasonable fee based on the administrative costs for any additional copy requested (article 15.3 of the RGPD). In the event of manifestly unfounded or excessive requests, IDIS may refuse to respond to these requests (Article 12.5 of the RGPD).

 

  • Right to correction: if you consider your personal data to be inaccurate or incomplete, you can request that this personal data be modified accordingly.

Procedures concerning your request for the right to correction

Please indicate precisely any inaccurate or incomplete data concerning you, and provide any information allowing them to be corrected or completed (Article 15 of the RGPD).

  • Right to erasure: you can request the deletion of your personal data, within the limits of what is permitted by law.

Terms and conditions regarding your request for the right to erasure:

Please indicate precisely the data concerning you for which you are requesting erasure, and the reasons for your request (Article 17 of the RGPD). Note: this right is not absolute. IDIS may be required to keep information about you as part of the management of its members, the collection of contributions or the handling of litigation.

  • Right to restriction: you can request the restriction of the processing of your personal data.

Modalities concerning your request for restriction of processing:

Please indicate precisely the data concerning you whose processing you are requesting to be restricted, and the reasons for your request. Note: this right is not absolute. IDIS may decide to continue processing your data (Article 18.3 of the RGPD).

  • Right of opposition: you can object to the processing of your personal data, for reasons relating to your particular situation. You also have an absolute right of opposition concerning the processing of your personal data for the purposes of market research, and including profiling insofar as it is linked to such market research.

Terms concerning your request for the right of opposition

Note: this right is not absolute. Please indicate precisely the processing for which you oppose the management of your personal data, and the reasons for your request (Article 21 RGPD).

  • Withdrawal of your consent: where you have given your consent for the processing of your personal data, you have the right to withdraw your consent at any time.
  • Right to data portability: in certain cases, you have the right to recover the personal data that you have provided to us, or when technically feasible, to request their transfer to another data controller.

In accordance with the applicable regulations, in addition to the rights mentioned above, you also have the possibility of filing a complaint with the CNIL (Commission Nationale Informatique et Libertés, 3 Place de Fontenoy – TSA 80715 – 75334 PARIS – www.cnil .fr) or any other competent supervisory authority.

To exercise these rights, please contact us. If you have a complaint about the way we process your data, we would like to know about it, but you also have the right to lodge a complaint with the supervisory authority (the data protection authority, such as the CEPD).
